Please join the CFMA of MA as we co-sponsor this event as part of Anderson & Kreiger’s “Buildings & Beers” discussion series.  The series is designed for interactive and informal discussion in a relaxed atmosphere featuring the area’s finest local craft brews and a host of other refreshments.  Payment disputes on construction project come in all forms – late payments, nonpayment, disputed amounts, bond claims, liens, and every issue in between. If not properly addressed – or avoided in the first place – resolving them can take on a life of its own, eating up time and (more) money, bogging down the project, and causing everyone pain.  A panel of construction attorneys and industry professionals from the owner and contractor sides will come together to offer their perspectives on payment issues that have hurt their projects in the past and the things they can do to ease – and avoid – similar “payment pain” in the future.  Two lawyers will weigh in from their experience and cover issues such as prompt payment obligations, protection against downstream claims, bonding issues, and legal and practical solutions to consider in contract drafting and midstream negotiation.

Jon Elder, Partner:

Jonathan T. Elder is a litigator who has spent most of his 20-year career advising public clients – among them cities and towns, transportation and highway authorities, and airports on a wide range of complex construction and litigation matters. He has represented both owners and contractors in connection with contract drafting and negotiation, project procurement, regulatory compliance, and, where necessary, dispute resolution.

Nina Pickering-Cook, Partner:

Nina L. Pickering-Cook founded A&K’s Construction Practice Group after years of advising and litigating construction issues on behalf of developer and public sector clients. Nina counsels owners, contractors, and developers in various phases of the construction process, starting with procurement, contract drafting and negotiation. Nina regularly litigates construction, real estate, and land use matters on behalf of her clients. That litigation background helps with her front-end work to anticipate key contract clauses needed to protect her clients based on their particular project.

John Hastings, CFO of Costello Dismantling:

John has been the CFO at Costello Dismantling since starting there in 2004. He joined CFMA Massachusetts shortly thereafter. John was elected to the Board of Directors and subsequently served as Treasurer, Vice President and ultimately as President of the Mass Chapter from 2015-2017. He received the CCIFP (Certified Construction Industry Financial Professional) designation in 2011.  John received his Bachelor of Science Degree in Accounting from Bryant University and his MBA from Anna Maria College.  Prior to working in the Construction Industry, John was in the Waste and Recycling Industry. His summer jobs in high school and college were working on and driving the collection vehicles.  After graduation, he worked his way up from driver to Vice President and Northeast Region Operations Manager for a national waste and recycling company.  John was then a co-owner of a local waste and recycling company, growing it by making seven acquisitions and ultimately selling it within a three year period. He has owned and sold several commercial real estate properties and continues to hold a Commonwealth of Massachusetts Real Estate Brokers License.  John is a former member of The Town of Westborough Capital Expenditures Committee.

 

Phil Palumbo, MCPPO:

Mr. Palumbo brings nearly 20 years of design, engineering, construction, and property management expertise to the Colliers’ Project Management team. With degrees in Architecture and Building Technology, Phil provides multi-faceted insight to his role as Director. Phil’s previous responsibilities have included on-site construction management, architectural design review with particular focus upon code compliance, constructability, project estimating and scheduling.  As a Massachusetts Certified Public Purchasing Official (MCPPO), Phil ensures our public clients are executing the different solicitation, bidding, procurement, and construction management responsibilities in a MA-compliant way.
